2.3 Design and Product Data

When you use our Services to create designs, we collect:

  • Prompts you submit for generating designs
  • Generated designs and images
  • Product preferences and order details
  • Moderation and safety signals (for example, whether a design is labeled NSFW), which may be produced by automated systems and/or human review

4. Sharing Your Personal Information

We do not sell, trade, or rent your personal identification information to others. We may share generic aggregated demographic information not linked to any personal identification information regarding visitors and users with our business partners and trusted affiliates for the purposes outlined above.

We may share your information with:

  • Service Providers: We may employ third-party companies and individuals to facilitate our Service, provide the Service on our behalf, perform Service-related services, or assist us in analyzing how our Service is used. These third parties have access to your Personal Data only to perform these tasks on our behalf.
  • Print and Fulfillment Partners: To fulfill your orders, we share necessary information with our print-on-demand and shipping partners.
  • AI Service Providers: We utilize third-party AI services (including the Recraft API) to generate designs. This may involve sharing your prompts and related information with those providers so they can generate images on our behalf. These providers process information subject to their own terms and policies and any agreements we have with them.
  • Payment Processors: We use third-party payment processors to handle financial transactions. We do not store your complete payment information on our servers.
  • Analytics and Advertising Partners: We use Google Analytics 4 and PostHog to understand how users interact with our Services. These services may use cookies and similar technologies to collect information about your use of the Services. If we use advertising services (such as Google Ads), those services may use information collected through cookies and similar technologies to show you ads for our Services on other websites and services. You can control cookies through your browser settings and opt out of certain advertising features as described in the "Cookies and Tracking Technologies" section below.
  • Legal Requirements: We may disclose your information if required to do so by law or in response to valid requests by public authorities.

5. User-Generated Content and Designs

Visibility and sharing: Prompts, descriptions, or other content you submit to our Services, as well as the designs generated from them ("Content"), may be visible to you and, where enabled by the Services, to other users or the public (for example through public discovery surfaces). We may display Content to operate the Services and for legitimate business purposes such as showcasing examples and improving the Services.

Public discovery and saving: Designs that are eligible for public discovery (for example, designs labeled as safe) may be displayed on public areas of the Services (such as the homepage), where other users may view and save them for display in their own accounts.

NSFW labeling and filtering: We may label certain designs as NSFW based on automated analysis and/or human review. We may use these labels and other safety signals to filter, restrict, or remove Content and to curate certain areas of the Services (for example, public discovery surfaces may be intended to exclude NSFW-labeled designs). However, automated labeling and filtering are not perfect, and you may still encounter Content you find offensive, inappropriate, or NSFW, including within your own designs or saved designs.

Persistence of Content: While you may delete designs from your account, copies may continue to exist on our platform, in backups, or elsewhere for a limited period. Content that has been made public or saved by other users may continue to be visible even after you delete it from your account.

Third-Party Design Services: We use the Recraft API to generate designs based on your prompts. We are not responsible for the output produced by these third-party services, including any potential issues with appropriateness, quality, or content of the generated designs. Information shared with these third-party services is subject to their own privacy policies and data handling practices.

6. Cookies and Tracking Technologies

We and our analytics providers may use cookies and similar technologies (such as device identifiers) to help operate the Services and understand usage.

Server logs: Our servers automatically collect certain information (such as IP address, browser type, pages visited, and timestamps) for security, debugging, and performance.

Analytics: We use Vercel Analytics and Google Analytics to understand how users interact with the Services. By default, Google Analytics typically uses cookies or similar identifiers.

Advertising: We currently use analytics for measurement and product improvement. We do not use Google Analytics for advertising or remarketing features today. If we begin using advertising services (such as Google Ads), we will update this Privacy Policy to reflect that use, and you will be able to opt out of personalized advertising through your browser settings or advertising opt-out tools.

Your choices: You can usually control cookies through your browser settings and other tools. Google also offers a Google Analytics opt-out browser add-on. If you disable cookies or tracking technologies, some parts of the Services may not function properly.

We may add or change analytics providers over time. If we do, we will update this Privacy Policy.

7. Data Security

We have implemented appropriate technical and organizational security measures designed to protect the security of any personal information we process. However, please also remember that we cannot guarantee that the internet itself is 100% secure.

Although we will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk. You should only access the services within a secure environment.

8. Data Retention

We will retain your personal information only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your information to the extent necessary to comply with our legal obligations, resolve disputes, and enforce our policies.

If you request deletion of your account, we will delete personal information associated with your account, subject to retention permitted or required by law and our legitimate business purposes (such as accounting and tax compliance, fraud prevention, and security). For example, we may retain certain transaction records and server logs for a limited period. Designs, prompts, and other Content you delete may persist in backups for a limited period, and Content that has been made public or saved by other users may continue to be visible.

9. Children's Privacy

Our Service does not address anyone under the age of 13. We do not knowingly collect personally identifiable information from anyone under the age of 13. If you are a parent or guardian and you are aware that your child has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from children without verification of parental consent, we take steps to remove that information from our servers.

Because the Services may include user-generated and AI-generated content that could be inappropriate for minors, we do not intend for children under 13 to use the Services.

10. Credit System and Payments

Our service uses a credit-based system for generating designs. We collect and process payment information when you purchase credits or products. We monitor credit usage to prevent abuse or manipulation of our systems.

Prohibited Activities: Attempting to manipulate our website or employ technical exploits to obtain more credits than you have been given or paid for is strictly prohibited. We monitor for such activities and may take appropriate action, including account termination, if such manipulation is detected.

Payment Information: Payment information is processed securely through our third-party payment processors. We do not store complete payment details on our servers but may retain certain information for transaction records, subscription management, and fraud prevention.

11. Your Data Protection Rights

Depending on your location, you may have certain rights regarding your personal information, such as:

  • The right to access, update or delete your information
  • The right of rectification
  • The right to object
  • The right of restriction
  • The right to data portability
  • The right to withdraw consent

To exercise your rights, contact us at support@stickyalchemy.com. We may need to verify your identity before responding. These rights may be limited by applicable law, and we may deny or limit a request where permitted (for example, where necessary to comply with legal obligations, protect security, or prevent fraud).

12. Changes to This Privacy Policy

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and updating the "Last updated" date shown below.

You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.
